IP Infringement during “Alimentaria 2016”: Rapid Intervention Protocol from Barcelona Courts

Throughout the fair “Alimentaria” (from today until April 28), Barcelona Courts have adopted a rapid intervention protocol to guarantee to the industry a high level of protection and legal certainty in cases of trademark, patent and industrial design infringement. After the success of the initiative during the  MOBILE WORLD CONGRESS (MWC), the largest fair in the world in the field of telecommunications, the agency “Fira de Barcelona” has again requested this service to the President of the Barcelona Courts.

What is the Rapid Intervention Protocol?

Barcelona Courts have committed to review and to respond quickly to the request for precautionary measures which may be filed in the days of the fair “Alimentaria”. Judges will evaluate the conditions for the adoption of precautionary measures in just two days, and will have to issue their decision while respecting the debate between the parties and the principle of effectiveness of the decision to be taken. This is certainly an excellent initiative which once again shows how Barcelona and Spain are right places to do #business, also in terms of the rule of law.
